Course Description
This course explores the major American legal tools for land uses and how these instruments allocate resources and scarcities as well as powers and disadvantages among social groups. We will read and discuss legal opinions, statutory materials, and secondary sources relating to eminent domain and regulatory takings, zoning and land use law, and, tangentially, private law of nuisance, easements, and covenants. We will examine these legal tools in the context of major changes that shaped American society today, from industrial growth management, suburbanization, and urban renewal to historic preservation, housing access, and environmental regulations.
