Course Description

The focus is on natural resource law and policy with an emphasis on NEPA and, to a lesser extent, the Administrative Procedure Act (APA), and how decisions regarding public land management are made within this legal framework. The course will also cover how such decisions are challenged in both administrative and judicial proceedings. It is taught as a simulation course where students will be given a set of facts and circumstances, will be assigned a role in the decision-making process, and will prepare various notices, documents, and responses required by NEPA process, as well as participate in administrative and judicial challenges to the decision made under NEPA.
