Course Description

Law and the Visual Arts will focus on the legal, policy, and ethical considerations at the intersection of law, art, and cultural heritage. The course will include discussion of the legal doctrines and case law that pertain to the visual arts and cultural heritage. It will also cover the non-legal principles and guidelines that inform decisions made by the courts, Congress, and museums, including recommendations made by government coalitions and guidelines issued by museum associations. In particular, this course will examine (1) the evolving legal definition of \"art\" and artists' rights under law, such as copyright law and moral rights; (2) the legal status and governance of museums, including the acquisition, display, and deaccessioning of artwork, with particular attention to COVID-19's effect on museum administration issues; (3) the role of the art market and the practices of auction houses, galleries, and dealers; (4) recovery and repatriation efforts related to Holocaust-era looted art, Indigenous peoples' cultural heritage, and antiquities; and (5) the significance of public monuments and legal and policy arguments concerning their display. Our investigation of these interrelated art law issues will help us to analyze who controls, regulates, and protects creative expression.
