Course Description

As Indian Tribes and Tribal members increasingly assert their civil rights within the federalist system, attorneys representing them in tribal, federal, and state courts must be familiar with the sources and scope of these rights. This course provides an overview of the tools used to advance Indian Civil Rights in such forums and the obstacles faced in doing so. Students will examine the intricacies of federal and Tribal court practice from a practical perspective. We will explore litigation related to Indian treaty rights; individual Indian civil rights, including disenrollment; natural resource disputes such as the DAPL affair; and state-Tribal jurisdictional disputes.
